There are risks associated with Trust Deed Investments that Investors should be aware of:

  1. Mt. Tai Asset Management, its principals, and associates are not allowed to guarantee the success of the investments. The investments involve certain risks and are suitable only for investors or entities who meet the following minimum criteria for net worth and income:

    $250,000 net worth exclusive of primary residence, home furnishings, and automobiles, and minimum of $65,000 income per year.
    OR
    $500,000 net worth exclusive of primary residence, home furnishings, and automobiles.
    Additionally, not more than 10% of your total net worth may be invested in any single investment.
  1. There is a possibility that given certain changes in economic conditions that the value of a property may fall below its loan amount.
  2. A borrower’s financial state and ability to repay the loan can change over time.
  3. If a borrower defaults your monthly payments will be interrupted. In certain cases it may be necessary to instruct Mt. Tai Asset Management to foreclose or take other actions to protect your investment. It is possible for the total amount recovered upon foreclosure to be less than the amount of your total investment, resulting in loss of capital to the investor.
  4. In the event of a foreclosure, investors will be requested to advance a fee of 1-2% of the loan amount to cover foreclosure costs.
  5. In the event of a bankruptcy of the borrower, the investor will be requested to advance an attorney fee to dismiss the case or lift a stay from bankruptcy. In general this fee is usually between $3,000.00 to $5,000.00.
